IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, YOU ARE NOT PERMITTED TO INSTALL, COPY, OR USE THE PROGRAM. BY ASKING FOR AN ACTIVATION KEY AND CLICKING THE ‘’I AGREE’’, YOU AGREE TO ALL TERMS OF THE SAID DISCLAIMER. NOTE THAT CHAOS PROGRAMMING IS THE SAID NAME OF OUR COMPANY (www.chaosprogramming.com) AND THAT OUR MAIN E-MAIL IS CHAOSPROGRAMMING@HOTMAIL.COM. A) Security measures:
GoldenGaia 8.0, GoldenGaia 8.1, GoldenGaia 8.2, GoldenGaia 8.3, GoldenGaia 8.4, GoldenGaia 8.5 and any subsequent and upgrades version of the said programs are guaranteed to be free of virus, macros, keyloggers and other dangerous softwares. It does store your account name and password in a .ini file, but this is purely for the use of the bot; it is not sent to us, any tierce person or anyone in the world and is simply for the bot to login.
GoldenGaia is not dangerous for your computer. It does not log any action or harm your computer in any way, neither was it made for it, or any other of our programms. All of our programs are legal.
B) Computer use:
GoldenGaia is a program that was made to simulate human actions. Therefore, by accepting this disclaimer, you accept the fact it might click, send messages, type text, copy images, copy link or do any other action a computer is capable of (See A for security purpose). Therefore, your computer will be used by our programmers.
GoldenGaia uses some processor speed, memory and other resources to work. Please consider this accordingly. It requires Internet Explorer 6.0, Windows XP and a working computer of at least 833Mhz/256 megs of ram to work. Please note and accept the fact that the program might also use your gaia online accounts to do all sorts of actions, such as, but not limited by, browsing the website, posting in forums and sending Private messages to users, some possibly containing publicity and/or information about us or the bot. By accepting this disclaimer, you agree to this and confirm you had at least this computer and its components.
C) Grant of a Limited Use License.
If you agree to this License Agreement, computer software (hereafter referred to as the "Program") will be installed onto your hardware.
D) Ownership.
All title, ownership rights and intellectual property rights in and to the program and all copies thereof (including without limitation any titles, computer code, themes, objects, characters, character names, stories, dialog, catch phrases, locations, concepts, artwork, character inventories, structural or landscape designs, animations, sounds, musical compositions and recordings, audio-visual effects, storylines, character likenesses, methods of operation, moral rights, and any related documentation) are owned or licensed by Chaos Programming. The Program is protected by the copyright laws of the United States, Canada, international treaties and conventions, and other laws. The Program may contain materials licensed by third parties, and the licensors of those materials may enforce their rights in the event of any violation of this License Agreement.
E) Responsibilities of End User
Subject to the license granted hereunder, you may not, in whole or in part, copy, photocopy, reproduce, translate, reverse engineer, derive source code from, modify, disassemble, decompile, or create derivative works based on the program, or remove any proprietary notices or labels on the program. Failure to comply with the restrictions and limitations contained in this Section 4 shall result in the immediate, automatic termination of the license granted hereunder and may subject you to civil and/or criminal liability. Notwithstanding the foregoing, you may make one (1) copy of the Program and the Manuals for archival purposes. GoldenGaia can only be used on one computer.
F) Termination.
This License Agreement is effective until terminated. You may terminate the License Agreement at any time by (i) permanently destroying all copies of the program in your possession or control; (ii) removing the program from your hard drive; and (iii) notifying Chaos Programming of your intention to terminate this License Agreement. Chaos Programming may terminate this Agreement at any time for any reason or no reason. In such event, you must immediately and permanently destroy all copies of the program in your possession and control and remove the Program from your hard drive. Upon termination of this Agreement for any reason, all licenses granted herein shall immediately terminate.
G) Export control
The Program may not be re-exported, downloaded or otherwise exported into (or to a national or resident of) any country to which the U.S. or the Canada has embargoed goods, or to anyone on the U.S. Treasury Department's list of Specially Designated Nationals or the U.S. Commerce Department's Table of Denial Orders. You represent and warrant that you are not located in, under the control of, or a national or resident of any such country or on any such list
H) Patches and notes
Chaos Programming may deploy or provide patches, updates and modifications to the Program that must be installed for the user to continue to use the Program. Chaos Programming may update the Program remotely, including, without limitation, the Program residing on the user's machine, without the knowledge or consent of the user, and you hereby grant to Chaos Programming your consent to deploy and apply such patches, updates and modifications. Note that we might scan and analyze other computer data in order to assure the security of our computer.
- Limitation of Liability, Indemnity
NEITHER CHAOS PROGRAMMING (www.chaosprogramming.com) NOR ITS PARENT, SUBSIDIARIES OR AFFILIATES SHALL BE LIABLE IN ANY WAY FOR ANY LOSS OR DAMAGE OF ANY KIND ARISING OUT OF THE PROGRAM OR ANY USE OF THE GAME, INCLUDING WITHOUT LIMITATION LOSS OF DATA, LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER DAMAGES OR LOSSES. FURTHER, NEITHER CHAOS PROGRAMMING NOR ITS PARENT, SUBSIDIARIES OR AFFILIATES SHALL BE LIABLE IN ANY WAY FOR ANY LOSS OR DAMAGE TO PLAYER CHARACTERS, VIRTUAL GOODS (E.G., ARMOR, POTIONS, WEAPONS, GOLD, ETC.) OR CURRENCY, ACCOUNTS, STATISTICS, OR USER STANDINGS, RANKS, OR PROFILE INFORMATION STORED BY THE PROGRAM AND/OR THE SERVICE. CHAOS PROGRAMMING SHALL NOT BE RESPONSIBLE FOR ANY INTERRUPTIONS OF SERVICE, INCLUDING WITHOUT LIMITATION ISP DISRUPTIONS, SOFTWARE OR HARDWARE FAILURES, OR ANY OTHER EVENT WHICH MAY RESULT IN A LOSS OF DATA OR DISRUPTION OF SERVICE. IN NO EVENT WILL CHAOS PROGRAMMING BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES. WE ARE NOT RESPONSIBLE FOR BANS, WARNING, OR GENERALLY ANY LOSS OF ACCOUNTS, TEMPORARY OR PERMANENT. WE ARE NOT RESPONSIBLE FOR ANY CONSEQUENCES OF USING THIS PROGRAM. We are in no way responsible if you get banned, warned, or have any action taken against you. We recommend using pauses for optimal security. We are not responsible for any loss, permanent or temporary, arising from using this bot, in a way or another. We are never responsible for any problem that arise from this bot, and you must understand and agree to this before using our program and more specificly GoldenGaia. In no event shall Chaos Programming’s liability, whether arising in contract, tort, strict liability or otherwise, exceed (in the aggregate) the total fees paid by you to Programming during the six (6) months prior to the time such claim arose. You hereby agree to defend, indemnify and hold Programming harmless from and against any claim, liability, loss, injury, damage, cost or expense (including reasonable attorneys' fees) incurred by Programming and normal using arising out of or from your use of the Game. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.
J) Changes to agreements
Chaos Programming reserves the right, at its sole discretion, to change, modify, add to, supplement or delete any of the terms and conditions of this License Agreement when Chaos Programming upgrades the Program, effective upon prior notice as follows: Chaos Programming will post notification of any such changes to this License Agreement on the Chaos Programming website and will post the revised version of this License Agreement in this location, and may provide such other notice as Chaos Programming may elect in its sole discretion. If any future changes to this License Agreement are unacceptable to you or cause you to no longer be in compliance with this License Agreement, you may terminate this License Agreement in accordance with Section F herein. Your installation and use of any updates or modifications to the Program or your continued use of the Program following notice of changes to this Agreement will demonstrate your acceptance of any and all such changes. Chaos Programming may change, modify, suspend, or discontinue any aspect of the program at any time. Chaos Programming may also impose limits on certain features or restrict your access to parts or all of the program without notice or liability. You have no interest, monetary or otherwise, in any feature or content contained in the Game.
K) Program use
THIS PROGRAM IS BEING USED FOR EDUCATIONAL PURPOSES ONLY. WE SELL IT ONLY IN THIS GOAL. YOU MIGHT NOT USE IT TO GAIN UNFAIR ADVANTAGES IN ANY KIND TOWARDS OTHER PLAYERS OR BREAK ANY TERM OF SERVICE BUT ONLY TO STUDY IT’S CORE, GUI, SCRIPT AND OTHER INTERESTING INFORMATION.
L) Payments notes
ONCE THE KEY HAS BEEN SHIPPED, THERE WILL BE NO REFUNDS IN ANY CASE. BY PURCHASING AND ASKING FOR A KEY, THERE WILL BE NO POSSIBLE REFUNDS. ALL FRAUD WILL BE INVESTIGATED AND REPORTED TO THE PROPER AUTORITIES, INCLUDING, BUT NOT LIMITED TO, FBI ONLINE, RGC, LOCAL POLICE FORCES AND OTHERS. PLEASE NOTE THAT YOU MIGHT NOT FILE A CLAIM OR START ANY COMPLAINT WITH PAYPAL, SUCH AS SIGNIFICANTLY NOT AS DESCRIBED OR NONE-DELIVERY, SINCE THIS IS A DIGITAL ITEM. PLEASE NOTE THERE IS NO REFUND SO BE SURE TO ACCEPT ALL THEREIN TERMS. PLEASE NOTE THAT WE RESERVE THE RIGHT TO BAN YOU FOR ONE OF THE FOLLOWING REASONS, OR ANY REASON, OR NO REASON AT ALL: THREATS TOWARDS US OR OUR COMPANY, ATTEMPT TO DISCREDIT OUR WORK OR STEAL OUR CREDIT, ATTEMPT TO BREAK OUR COPYRIGHTS, ATTEMPT TO CRACK THE BOT, ATTEMPT TO ILLICITLY REPRODUCE THE BOT, BREAK OF ANY TERMS OF THIS PRESENT DOCTUMENT HEREBY NAMED TERMS OF SERVICE, MISUSE OF OUR BOT OR ANY ILLEGAL ACTIVITY. This disclaimer applies from the moment you click accept to the moment you terminate your agreements (See preceding points).
M) Legal liability & Miscellaneous.
WE ARE NOT RESPONSIBLE FOR ANY CONSEQUENCES OF USING THIS PROGRAM. If you are a Gaia employee, founder, co-founder, member or any other associates of friend, you might not use this program. You might not harass us or generally importunate us. If you do not follow these guidelines, you are violating Bill Clinton Internet Privacy act. Since this program is being sold solely for education purposes, you might not sue, harass, or interfere with our programs, websites or affiliates, programs, employees or generally any part of Chaos Programming. Again, this is only sold for educational purpose; therefore we are not violating any part of your TOS against hacking. ‘’Gaia’’ is a term deposed by Gaiaonline.
